All disputes arising out of this agreement or your visit to Funtober will be resolved by BINDING ARBITRATION in accordance with the appliable rules of the American Arbitration Associate then in effect. The arbitration will be held in Philadelphia, Pennsylvania or a mutually agreeable location. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury. Your claims cannot be brought as a class action. An award of arbitration may be confirmed in a court of competent jurisdiction.

This agreement shall be governed by the laws of the Commonwealth of Pennsylvania.

Should any provision of this agreement be held unenforceable, all remaining provisions shall remain in full force and effect.

We may modify these terms in our sole discretion, without advance notice. You should visit this page frequently. Your access to this site will be governed by the new terms when they are posted here. This agreement may not be otherwise amended except by a written document duly executed by both parties.
